Acceptance of Terms
By clicking “I Agree” or by otherwise accessing or using the Website, you confirm that you have read, understood, and agreed to be bound by these Terms of Use (“Agreement”). If you do not agree to these Terms, do not create an account and do not access or use the Website.
If you accept these Terms on behalf of another individual or entity, you represent that you have the authority to bind that person or entity to this Agreement.
Emergency Notice / Medical Disclaimer
If you are experiencing a medical emergency, call 911 or seek immediate in-person emergency medical care.
The Website and related services are not appropriate for every medical condition or concern. Always consult your primary care provider before beginning any new treatment. These Terms may be updated from time to time as described below.
Introduction
This website, together with any related mobile application, platform, portal, software, or connected system, including all information, products, and services made available through it (collectively, the “Website”), is owned and operated by Robinhood Telehealth (“Company,” “we,” “us,” or “our”).
The Website provides information, education, and access to certain products and services for users (“you” or “Customer”). Some features may be subject to additional guidelines, terms, or rules posted in connection with those services, and those additional terms are incorporated into this Agreement by reference.
Customer Account
You are not required to register to browse certain portions of the Website. However, some services are available only to users who create an account or receive access credentials (“Customer Account”).
You represent and warrant that all information you submit during registration is truthful, accurate, and complete, and that you will keep it current, including your email address and contact information.
We reserve the right to suspend or terminate your account as permitted under these Terms.
Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You may not use another person’s account. We are not liable for any loss or damage arising from your failure to protect your account information.
Electronic Communications Consent
When you visit the Website or communicate with us by email, phone, or text message, you consent to receive communications from us electronically.
We may communicate with you by email, text message, phone, through the Website, or through your customer portal or back office. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.
You also agree that electronic notices are deemed received on the date they are sent or posted.

Recording Consent

These Recordings may be used for quality assurance, training, service delivery, documentation, and improvement of the platform. We will treat such Recordings as confidential and will not publicly disclose them unless required by law.
By using the Website or platform, you consent to such Recordings as described in these Terms and in the Privacy Policy.
Eligibility / Age Requirement
The Website is intended only for individuals who are 18 years of age or older.

Changes to These Terms
We may revise these Terms of Use at any time by posting an updated version on the Website.
Changes become effective immediately upon posting. Your continued use of the Website after updated Terms are posted constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must stop using the Website and related services.
Relationship With Us and Third Parties
The Website may make available products and services offered by Robinhood Telehealth and/or by independent third-party providers, pharmacies, or vendors.
Prescription fulfillment may be handled by third-party pharmacies. The Website may also facilitate access to independent licensed healthcare providers or medical groups (“Providers”) who deliver medical services.
By accepting these Terms, you acknowledge and agree that services or products received from Providers and/or pharmacies may also be subject to this Agreement, and that such parties may be third-party beneficiaries of these Terms where applicable.
Robinhood Telehealth does not practice medicine and does not control or interfere with the professional judgment of any Provider. Each Provider is solely responsible for the medical care, treatment decisions, and prescriptions they provide to you.
Your use of the Website does not create a doctor-patient relationship between you and Robinhood Telehealth. However, your use of the Website may create a doctor-patient relationship between you and a licensed Provider.
Likewise, we do not control or interfere with the professional services of pharmacies, and each pharmacy is solely responsible for the services it provides.
Provider Communications
By accepting this Agreement, you understand and agree that Providers may contact you through the Website, by email, or by SMS regarding diagnosis, treatment, prescriptions, and related care communications.
You understand that Robinhood Telehealth is not responsible for the security or privacy practices of your mobile carrier, email provider, or other third-party communications services you use to receive these communications.
You are solely responsible for reviewing and responding to Provider messages and following medical guidance. Neither Robinhood Telehealth nor any Provider is responsible for losses, injury, or claims resulting from your failure to read, respond to, or follow such communications or recommendations.
Subscriptions, Prescriptions, and Services
Certain services may be offered on a recurring subscription basis.
By purchasing a subscription, you authorize Robinhood Telehealth to charge your selected payment method at the intervals disclosed during checkout, in related purchasing materials, or on the product page.
Your subscription will continue until canceled in accordance with these Terms. You are solely responsible for managing your subscription.
If you do not cancel at least 72 hours before your renewal date, your subscription may renew automatically and you will remain responsible for the resulting charges.
Renewal timing is based on the subscription term associated with your original purchase. Cancellation takes effect at the end of the current subscription period unless otherwise stated.
Cancellation
To cancel your subscription, you must email:
Your cancellation request must be submitted at least 72 hours before your renewal date.
Administrative Cancellation Fee / Refund Limits
If you cancel after payment has been processed but before a prescription is transmitted to a Provider or pharmacy, a $99 administrative cancellation fee may be deducted from any eligible refund.
If the prescription has already been processed by the pharmacy, you are responsible for the full subscription cost and no refund will be available.
If a service includes a required minimum initial term, such as a three-month commitment, and you fail to cancel before renewal, you may remain responsible for the full renewal term even if you do not use the service.
If you are paying in installments, you remain responsible for any unpaid balance even if you cancel before completing the full term.
Required Documentation and Reassessments
You are responsible for timely providing any requested documentation, which may include:

Videos
ID verification
Medical assessments
Follow-up information
Delays in providing requested documentation may delay services or fulfillment, but your payment obligations will still apply.
Where required, medical reassessments must be completed before further shipment or fulfillment.
Financing Plan Changes
If you are using a financing option and want to switch to a full payment plan after renewal, contact support within seven (7) business days. If applicable, the remaining balance may be charged without a finance charge.
Courtesy Communications
Robinhood Telehealth and/or Providers may send courtesy reminders regarding updates, renewals, follow-up steps, or service needs. However, you remain solely responsible for monitoring your subscription, renewal dates, and account status.

Financial Responsibility for Services
Robinhood Telehealth is not enrolled as a participating provider in federal or state healthcare programs, including but not limited to Medicare or Medicaid, for the services or products offered through the Website.
Even if a Provider or pharmacy participates in such programs separately, the products and services made available through this Website are typically provided on a cash-pay basis and are generally not submitted for reimbursement through federal or state healthcare programs.
By using the Website, you agree that you are solely responsible for all charges related to products and services obtained through the Website.
Neither you, Robinhood Telehealth, any Provider, nor any pharmacy will submit claims for reimbursement to Medicare, Medicaid, or similar government healthcare programs for costs associated with Website-based services or products.
Payment Default Policy
Timely payment is required for all services and subscriptions.
Payments not received by the due date may be considered delinquent. We may attempt to collect payment for up to three (3) days following the due date. If payment is still not received by the end of that period, a $30 late fee may be assessed.
Additional collection attempts may be made, and notifications may be sent regarding overdue balances.
After a 30-day grace period, a final warning may be issued. If payment remains unpaid, your account may be sent to a collection agency, and additional lawful collection efforts may occur.
You are responsible for ensuring that:
Your payment method is valid
Adequate funds are available
You have not opted out of communications that may contain billing notices
We are not required to provide advance notice before assessing late fees.
If your account remains unpaid for thirty (30) calendar days after notice of delinquency, it may be considered in default. This may result in suspension of services, termination of access, and referral for collection activity.
Collections
If your account becomes seriously past due, we may provide written notice by email. If payment is still not received after thirty (30) calendar days, the account may be referred to a collection agency.
Where permitted by law, any additional fees charged by a collection agency may become your responsibility and may be added to the outstanding balance.
Child-Resistant Packaging Notice
Use caution when storing all medications.
Prescriptions filled by third-party pharmacies may not be provided in child-resistant containers or packaging. It is your responsibility to store all medications safely and out of reach of children.
Consent to Use Telehealth Services
Telehealth involves the delivery of healthcare services through electronic communications and information technology when a patient and Provider are not physically in the same location.
Telehealth may offer convenience and improved access, but it also has limitations and may not be appropriate for every condition or concern.
To access telehealth services, you may be required to review and accept a separate telehealth informed consent or patient consent form presented through the Website. You agree that Robinhood Telehealth may be a third-party beneficiary of that consent where applicable.
Your Responsibility for Technology and Information
You are responsible, at your own expense, for obtaining and maintaining compatible hardware, software, devices, and Internet access necessary to use the Website.
This may include a device with video capability if required for certain services.
You are also responsible for all Internet, mobile, and data charges associated with your use of the Website.
You agree to provide truthful, accurate, and complete information in any forms, submissions, or communications made through the Website.
We reserve the right to update technical requirements for using the Website at any time without prior notice.
Protected Health Information
When you create an account, you may provide information such as your name, email address, shipping address, and phone number. This information may be used and disclosed in accordance with our Privacy Policy.
You may also provide medical or health-related information that may be protected under applicable law.
Robinhood Telehealth is not necessarily a “covered entity” under HIPAA. Independent Providers and pharmacies may be covered entities or business associates, and Robinhood Telehealth may in certain circumstances act as a business associate.
Where applicable, Robinhood Telehealth will comply with legal obligations related to protected health information (“PHI”). Information that is not considered PHI under applicable law may be used and disclosed as described in our Privacy Policy.
De-identified data is not considered protected health information under HIPAA.
Providers may also maintain separate telehealth consent forms, privacy notices, or related disclosures. By using the Website, you acknowledge receipt of any applicable notices and understand that information not submitted solely for diagnosis, treatment, or prescription fulfillment may be governed by our Privacy Policy and applicable law rather than HIPAA.
Governing Law
These Terms of Use are governed by the laws of the State of California and applicable federal law, without regard to conflict of law rules.
Arbitration Agreement
Any dispute, claim, or controversy arising out of or relating to these Terms of Use or your use of the Website shall be resolved through mandatory binding arbitration administered by the American Arbitration Association (AAA).
By agreeing to these Terms, you understand and agree that:
You are waiving the right to a jury trial
You are waiving the right to participate in a class action or representative proceeding
Arbitration will take place on an individual basis only
Arbitration may be conducted remotely by video conference or other virtual means unless otherwise agreed
Before starting arbitration, you must first send written notice of the dispute to:
Any claim must be brought within one (1) year from the date of the event giving rise to the dispute, to the fullest extent permitted by law.
Disputes may only be resolved through individual arbitration. No class arbitration, class action, consolidated action, or representative proceeding is permitted. The arbitrator has no authority to hear or combine class or representative claims.
To the fullest extent permitted by law, both parties agree to keep arbitration proceedings confidential.
If any part of this arbitration provision is found invalid or unenforceable, the remaining portions shall remain in full force and effect.
California Civil Code Section 1542 Waiver
By agreeing to these Terms, you waive any rights under California Civil Code Section 1542, which states:
A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.
